Sergeant Fannie Nkosi Challenges Charges, Labels Case Against Him as Baseless

Sergeant Fannie Nkosi has firmly rejected all allegations leveled against him, asserting that the prosecution’s case lacks substance and credibility.

Appearance at Pretoria North Magistrate’s Court and Background

On Monday, Nkosi appeared before the Pretoria North Magistrate’s Court to formally apply for bail. His arrest occurred on Thursday, 2 April, when the Madlanga Commission of Inquiry’s task team conducted a raid on his Pretoria residence following his testimony. The charges he faces include obstructing justice, unlawful possession of ammunition and explosives, and theft. Nkosi is expected to enter a plea of not guilty to all accusations.

Legal Defense and Bail Application

During the court session, Advocate Sizo Dlali, representing Nkosi, presented an affidavit advocating for his release on bail. Nkosi maintains that the allegations are entirely fabricated and without merit.

He emphasized, “I confirm that I have no family members, business interests, or assets outside South Africa, and I do not engage in any international business activities. Therefore, I am not a flight risk.”

Nkosi also highlighted his clean criminal record, stating, “I have never been convicted of any crime within South Africa or abroad. Apart from this ongoing investigation by the South African Police Service, I have no other pending cases.”

Refuting Firearms-Related Allegations

Addressing claims that he failed to secure his firearms in an approved safe or strongroom, Nkosi categorically denied these accusations, clarifying that the firearms were neither under his direct control nor unlawfully stored.

He explained, “The firearms seized during the police search at my home are all legally licensed. I possess valid permits and have paid the necessary fees to lawfully own these weapons.”

Nkosi further detailed that when the National Task Team officers requested access to his firearms safe, he directed them to a wall-mounted safe in his residence, where seven licensed firearms and corresponding ammunition were found.

Critique of the Prosecution’s Evidence

Nkosi disputed reports that firearms were discovered under his bed or inside his vehicle, insisting that all weapons confiscated were located within the secure safe at his home.

He argued, “The prosecution’s case is fundamentally weak and lacks credible evidence. Additionally, I am accused of stealing dockets found in my possession; however, as a member of the task team handling cash-in-transit robberies and violent crime investigations, these dockets were legitimately in my custody at the time of my suspension.”

He maintained that these charges are part of a broader attempt to target and victimize him, stating, “I deny the claim that a stun grenade was found during the police search; this allegation is entirely fabricated.”

Absence of Violent Crime Charges and Public Safety Considerations

Nkosi pointed out that he has not been charged with any violent offenses, which supports his argument that he does not pose a threat to the community or witnesses involved in the case.

He noted, “I am unaware of any witnesses the prosecution intends to call, aside from the police officers present during my arrest and the execution of the search warrant.”

He pledged, “I have no intention of interfering with any witnesses and commit to refraining from such actions. There is no risk to public safety should I be granted bail.”

Bail Proposal and Financial Capacity

Nkosi’s family has indicated their ability to post bail set at R10,000.
